The petitioner undertakes to affirm and stamp the petition as per the Rules within one week of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

The petitioner claims that the petitioner has been in custody for a considerable period of time and there is no basis to proceed against the petitioner.

The State relies on the statement of the minor survivor recorded under Section 164 of the Code. The State says that the survivor identified this petitioner in course of the Test Identification Parade. The statement of the minor survivor is also clear.

Considering the material against the petitioner, the prayer for bail is refused.

CRM 7813 of 2020 along with the interim application therein stand disposed of.
