The petitioner undertakes to affirm and stamp the petition/application as per Rules within 48 hours of resumption of normal functioning of the Court. Subject to such undertaking, the application is taken up for hearing through video conference. Considering the nature and gravity of the offence and the materials in the Case Diary including the statement under Section 164 of the Cr.PC of some of the witnesses and the identification of the petitioner during the test identification parade and also having regard to the fact that evidence of the prosecution is in progress we are not inclined to allow this application for bail.

We request the Additional Sessions Judge, 5th Court, Howrah to expedite the trial and complete the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties.

With the aforesaid observation, the application for bail being CRM 7815 of 2020 is disposed of.
