The petitioner undertakes to affirm and stamp the petition/application as per Rules within 48 hours of resumption of normal functioning of the Court. Subject to such undertaking, the application is taken up for hearing through video conference. Having considered the statement of the victim girl under Section 164 of the Code of Criminal Procedure read with the report of the Medical Officer Cooch Behar and the statement of the independent witnesses under Section 161 of the Code of Criminal Procedure directly implicating the petitioner we are not inclined to release the petitioner on bail. The application is stand dismissed.
