The petitioner is running a shop room at the premises No. 7/2A, Gobind Chand Dhar Lane, P.S.- Burrabazar, Ward No. 42, Kolkata-700001.

He has made an application before the Kolkata Municipal Corporation praying for a permission to install a rolling shutter covering the window display. The said application was made on 1st September, 2020. The petitioner complains that his application has not been considered by the respondent authorities till date.

None appears to oppose the writ petition on behalf of the KMC, in spite of service.

As it appears that the application of the petitioner praying for installing the rolling shutter is pending consideration at the end of the respondent authority, no useful purpose will be served by keeping the writ petition pending.

Accordingly, the writ petition is disposed of by directing the Executive Engineer, Building Department, Borough-V, Ward No. 42 being the respondent no. 3

herein to take a decision with regard to the application of the petitioner, strictly in accordance with law, within a period of ten weeks from the date of communication of a copy of this order.

The said respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.

It is made clear that this Court has not gone into the merits of the claim of the petitioner and all points are left open to be decided by the said respondent at the time of consideration of the representation of the petitioner.

W.P.A. 8292 of 2020 is disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
