The present revision has been preferred against the judgment and order dated 08.01.2020 passed by the learned Additional District and Sessions Judge, 18th Court, South 24 Parganas, Alipore in Criminal Motion No. 07 of 2019 in connection with ACM No. 176 of 2011, adjudicated before the Court of learned Judicial Magistrate, 4th Court, South 24 Parganas, Alipore, which directed, payment of maintenance of Rs.5,000/- to the opposite party from the date of filing of the application.
In spite of the best efforts on the part of the petitioner, service could not be effected either upon the opposite party/wife or upon the learned counsel appearing for the opposite party/wife before the trial Court. The present revision has been preferred in respect of orders which have finally disposed of the petition under Section 125 Cr.P.C.
Considering the materials on record and the submissions of the learned counsel for the petitioner, regarding the change in circumstances and the relief sought
for, the present revisional application is disposed of by granting leave to the petitioner to approach the trial Court under the appropriate provisions of law for necessary relief. All connected application, if any, stands disposed of. Interim order, if any, stands vacated.
Let a copy of the order be sent to the learned trial court for compliance.
