Ct-24 ar 05.01.2021 WPA 8342 of 2020 Budhadev Mallick Vs.

Union of India & Ors.

Mr. Debasish Chattopadhyay ... For the Petitioner Mr. Madan Murari Verma Mr. Arijit Majumdar ... For the Union of India Supplementary affidavit filed by the petitioner is retained with the record.

The petitioner participated in the recruitment process of the CAPF (Central Armed Police Forces). He was declared unfit by the Medical Officer.

Being aggrieved he preferred an appeal before the Review Medical Board. The Review Medical Board was of the opinion that the petitioner was unfit for service.

The petitioner has filed the instant application praying for a direction upon the respondents for conducting his medical examination by a separate Doctor on the basis of the medical certificate, which was issued in his favour by the Doctor of the State Government Hospital.

The petitioner files the supplementary affidavit annexing a letter dated 22nd October, 2020 issued by the Undersecretary of the Staff Selection Commission whereby the request of the petitioner for conducting a medical examination has been forwarded to the D.I.G (Recruitment). The Undersecretary requested the D.I.G to take necessary action in the matter.

As it appears that the prayer of the petitioner

for re-examination is pending consideration at the end of the CAPF authority, no useful purpose would be served by keeping the writ petition pending. The same is accordingly disposed of. The respondents will take necessary action pursuant to the letter dated 22nd October, 2020. WPA 8342 of 2020 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
