The State of West Bengal and others Mr. Kamalesh Jha, Ms. Sraboni Biswas .... for the petitioner.

Mr. Sandip Dawn ... for the private respondents.

The petitioners' complain that the private respondents are attempting to encroach upon their land of Dag nos. 525 and 540 within Mounza-Jagacha, Dist.-Howrah.

Counsel for the private respondents undertakes before this Court that they do not intend to encroach upon the petitioners' land or conduct any puja thereat. The private respondents undertake to conduct their puja outside the premises of the petitioners. In the above circumstances, the Officer-inCharge, Jagacha Police Station shall ensure personally that no part of Dag nos. 525 and 540 shall be encroached upon by the private respondents in conducting the puja.

In the event of any encroachment, the petitioners and the Officer-in-Charge, Jagacha Police Station shall remove any structure that may have been constructed on the petitioners' land by the private respondents.

The Officer-in-Charge, Jagacha Police Station shall render assistance to the petitioners at their costs to carry out the aforesaid order.

With the aforesaid directions, the instant writ petition shall stand disposed of.

All parties are to act on a server copy of this order on usual undertakings.
