The learned advocate appearing for the petitioners submits that the petitioners are in custody for a considerable period of time. However, learned advocate for the petitioners candidly submits that the trial is at an advance stage and the case is being hauled up only for not producing the original case diary before the learned trial court.

Mr. Bardhan, learned advocate appearing for the State opposes the prayer for bail of the petitioner and submits that out of twenty-two witnesses about 15/16 witnesses have already been examined and as the original case diary is lying with the

learned advocate for the State, the trial could not be proceeded in the schedule fixed in the moth of January, 2021. In view of the advance stage of the trial, we are not inclined to release the present petitioner on bail. Accordingly, the prayer for bail of the present petitioners is rejected.

Learned advocate for the State is directed to produce the original case diary tomorrow i.e., 19th January, 2021 before the learned trial court so that the available witnesses can be examined by the learned trial court. No unnecessary adjournments should be granted to either of the parties and the learned trial court should take all steps so that within a reasonable period of time the case can be taken to its logical conclusion.

With the aforesaid observations, the application for bail being CRM 7897 of 2020 along with connected application, if any, is, accordingly, disposed of.
