CRM No. 7911 of 2020 (Via video conference) In Re:- An application for anticipatory bail under section 438 of the Code of Criminal Procedure in connection with Arambagh Police Station Case No. 172 of 2020 registered for investigation into offences punishable under Sections 420/468/469/471/500/505/120B of the Indian Penal Code read with Sections 51/54 of the Disaster Management Act, 2005.

And In the matter of : Suraj Ali Khan ... Petitioner Mr. Pintu Karar Mr. Akash Deep Mukherjee .. for the petitioner Mr. Neguive Ahmed Ms. Amita Gaur ..for the State The petitioner undertakes to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. Subject to such undertaking, the application is taken up for hearing through video conference.

Learned APP for the State has fairly submitted that the persons similarly placed as that of the petitioner have been granted anticipatory bail by a co-ordinate Bench. Learned APP has referred to the order dated 28th August, 2020 in CRM 5998 of 2020.

We appreciate this fair submission on behalf of the learned APP.

Under such circumstances, we are inclined to grant anticipatory bail to the petitioner on the same terms as that of the order passed in CRM 5998 of 2020. Accordingly, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount, one of whom must be local, to the satisfaction of the arresting officer on the condition that the petitioner shall cooperate with the investigation and shall meet the Investigating Officer as and when required.

The petitioner will abide by the conditions in Section 438(2) of the Code of Criminal Procedure.

Accordingly, the application for anticipatory bail being CRM 7911 of 2020 is allowed.
