Mr. Sakti Pada Jana, learned Counsel appearing on behalf of the petitioner submits that his particular case was wrongly tagged along with other matters in the order dated April 16, 2021 wherein this Court had relied on the judgement delivered on March 25, 2021 in W.P.A.14468 of 2013 (Animesh Choudhury Vs. State of West Bengal & ors.). He, accordingly, prays that the order be recalled in so far as his matter is concerned.

In light of the same, the application being CAN 1 of 2021 in W.P.A.8398 of 2020 is allowed.

The order dated April 16, 2021 passed in W.P.A.8398 of 2020 is recalled and the writ petition being W.P.A.8398 of 2020 is restored to its original file and number.
