CRM 7926 of 2020 (Through Video Conference) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Nowda P.S. Case No.46 of 2017 dated 04.03.2017 under Sections 302/307/34 of the Indian Penal Code.

And In the matter of: Aminul Mondal .... Petitioner Ms. Sonali Das ... For the Petitioner Mr. Madhusudan Sur Mr. Dipankar Pramanick ... For the State The petitioner undertakes to affirm and stamp the petition as per the Rules within one week of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

The petitioner says that the petitioner has been in custody for more than three years.

The State says that there is enough material against the petitioner and the matter is due to be taken up by the trial court on December 3, 2020. The State refers to the earlier rejection of the prayer of the petitioner by this Court and to the statement of the victim's son who claims that the petitioner herein attacked the victim and the victim ultimately died.

Considering the material against the petitioner, his prayer for bail cannot be acceded to at this stage and is refused. CRM 7926 of 2020 is disposed of.
