The petitioner has applied for relief for house building allowed pursuant to the notification of the Department of Disaster Management and Civil Defence dated 25th June, 2020. The petitioner submits that his application was rejected on the ground that he had a pucca house.

It is argued by the learned counsel for the petitioner that the notification dated 25th June, 2020 confers entitlement of the petitioner notwithstanding the fact that he has a pucca house, if damage, is caused by reason of the Amphan cyclone. The petitioner has made a representation to the SDO concerned and the District Magistrate, Purba Medinipur in this regard. WPA 8410 of 2020 is disposed of by directing the District Magistrate, Purba Medinipur and/or any person that may be authorised by the said District Magistrate to consider and dispose of the petitioner's representation dated 28th August, 2020 in accordance with law preferably within a period of two months from the date of communication of a copy of this order. A reasoned order may be passed and the same may be communicated to the petitioner within ten days thereafter. There shall be no order as to costs.
