SG CRM 7944 of 2020 with CRAN 1 of 2020 In Re. An application for bail under Section 438 of the Code of Criminal Procedure in connection with English Bazar Women Police Station Case No.86 of 2020 dated 07.09.2020 under Sections 498(A)/307 of the Indian Penal Code and Section 4 of the D.P. Act.

The petitioners undertake to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking. The petition is dismissed as regards the third petitioner since, according to the remaining petitioners, he has already obtained regular bail.

The first petitioner is the husband of the de facto complainant and the other petitioner is the mother of the first petitioner.

The State refers to the complaint and to the statement rendered by the complainant. However, there does not appear to be any report of any serious injury.

In the circumstances, the first and second petitioners are entitled to anticipatory bail.

In the event of arrest, the first and second petitioners will be enlarged on bail upon furnishing a security of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer. The first and second petitioners will also abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973. CRM 7944 of 2020 and CRAN 1 of 2020 are disposed of.
