CRM 7953 of 2020 (Through Video Conference) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Mothabari P.S. Case No.187 of 2020 dated 19.05.2020 under Sections 302/34 of the Indian Penal Code.

For the State The petitioner undertakes to affirm and stamp the petition as per the Rules within one week of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

The petitioner claims that he had no role in the incident which led to the death of one person.

The State produces at least one statement of a witness which claims that this petitioner and Abrul repeatedly stabbed the victim that led to his ultimate death. The State also claims that following the statement of this petitioner, the offending weapon was discovered from his residence.

Considering such material and the nature of the charge, the petitioner's release is not called for. The prayer for bail is refused. CRM 7953 of 2020 is dismissed.
