Case No. 169 of 2020 dated 17.08.2020 under Sections 489B/489C of the Indian Penal Code. Mr. Asraf Mondal ...for the petitioner. Mr. Rana Mukherjee Ms. Sujata Das ... for the State. The advocate-on-record for the petitioner undertakes to affirm and properly stamp the petition as per the rules within one month of resumption of normal functioning of the court. The petition is taken up through video-conference on the basis of such undertaking. The learned advocate for the petitioner submits that the petitioner is in custody for about 93 days and charge-sheet has already been submitted. The further submission of the learned advocate that only four fake currencies were recovered from the possession of the petitioner.
Learned advocate for the State opposes the prayer for bail and submits that sixteen fake currency notes were recovered from the possession of the petitioner and the opinion of the expert is still awaiting.
We have taken into account the nature of the seizure which
were effected and the manner in which the police carried out search which reflects initially four currency notes were tendered to the complainant and thereafter on search of the person, another twelve fake currency notes were recovered.
Having regard to the nature of the offence, we are not inclined to release the petitioner on bail.
As such the prayer for bail of the petitioner is rejected. With the aforesaid observation, the application for bail, being CRM No. 7959 of 2020 is disposed of.
