By consent of the parties, the appeal and the application are treated as on day's list and taken up for hearing.
Mr. Amal Kumar Sen, learned Advocate appearing for the respondent Nos.3 to 6, has submitted that the impugned order has been acted upon. The writ petitioner has participated in the proceeding and the concerned authorities after hearing the petitions have passed a reasoned order. It is further submitted that the order passed by the authority concerned in terms of the order dated 9th October, 2020 has been recently challenged in a separate writ petition by the writ petitioner. Learned Counsel for the appellant while accepting the submission of Mr. Sen has submitted that the petitioner appeared before the authority under compulsion.
In view of the fact that the order dated 9th October, 2020 has been given effect to and a fresh order has been passed which is now under challenge in a separate writ petition, there is no scope for this Court to interfere with the order dated 9th October, 2020.
We make it clear that we have not gone into the merits of the matter and this order shall not prejudice the pending writ petition.
