The petitioners undertake to affirm and stamp the petition as per the Rules within one week of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.
This is another instance of sharp practice by seeking anticipatory bail without referring to the previous rejection of the same prayer by this court.
The previous petition was rejected on February 27, 2020 and there has been no change in the circumstances since then. In any event, the petition is not fashioned as a second petition upon there being any change in circumstances. It will not do for Advocate to
say that he was not properly instructed, since considerable court time is wasted in such matters. The petitioners will immediately surrender and the petitioners will not be entitled to seek bail for a period of six months from the date of the petitioners' surrender or arrest, whichever is later. The petitioners will not be granted bail without paying costs assessed at Rs.5,000/-, in addition to whatever surety or security the petitioners are required to put up for obtaining bail.
CRM 7989 of 2020 and the interim application stand disposed of.
