Bhattacharjee ... for the State The petitioner's case is this that he applied for a permit in respect of a particular Stage Carriage in Form No.1 under Rule 123 of West Bengal Motor Vehicle Rule, 1989 which is at page 13 and 14. Subsequently, on 12th February, 2020 the petitioner filed one representation for considering the said application in view of vacancy arising out of not plying and/or expiry of permit of vehicle WB-04D/1004. The petitioner's grievance is that neither the said application in form no.1 nor the representation has been considered by the respondent no.2 till date. The learned advocate appearing for the respondent no.2 submits that the matter was taken up for consideration but it was deferred.

The learned advocate for the respondent no.2 further submits that the application and the representation of the petitioner will be taken up for consideration by three weeks from date.

In view of such submission, I direct the Regional Transport Authority to consider the aforesaid application and the representation within a period of three weeks from date after giving an opportunity of hearing to the petitioner and to take a decision thereafter by two weeks from date of such hearing and to communicate the decision by two weeks thereafter. With the above direction the writ petition is disposed of.
