Musibar Gain v. State Of West Bengal
20.10.2020 Suppl/7 b.das CRM 8016 of 2020 (Via Video Conference) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Bhangore P.S. Case No.388/2019 dated 11.07.2019 under Sections 376(3)/376D/506 of the Indian Penal Code and Section 6 of the POCSO Act. And In the matter of: Musibar Gain ....Petitioner.
Mr. Angshuman Chakraborty ...for the Petitioner.
Mr. S.G. Mukherjee, Ld. PP.
Mr. A. Mitra ...for the State.
Petitioner is in custody for 1 year and 3 months. It is submitted that there is a love affair between the parties. Learned Public Prosecutor opposes the prayer for bail. We have considered the materials on record and in view of the prima facie involvement of the petitioner as appearing from the statement of the minor who was subjected to forcible sexual intercourse, which prima facie appears to be convincing, we are not inclined to grant bail to the petitioner at this stage. The parties shall act in terms of the copy of the order downloaded from the official website of this Court.
