CRM No. 8018 of 2020 (Via video conference) In Re:- An application for anticipatory bail under section 438 of the Code of Criminal Procedure in connection with Berhampore Police Station Case No. 832 of 2020 dated 19.08.2020 registered for investigation into offences punishable under Sections 498A/325/307/506/34 of the Indian Penal Code and Sections 3 and 4 of the D.P. Act.

Kutubuddin ..for the State The petitioners undertake to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. Subject to such undertaking, the application is taken up for hearing through video conference.

Having considered the materials on record and the nature and extent of complicity of the petitioners in the commission of the alleged offence, we are inclined to grant anticipatory bail to the petitioner No. 2. Accordingly, in the event of arrest, the petitioner No. 2 shall be released on bail upon furnishing a bond of

Rs.10,000/-, with two sureties of like amount, one of whom must be local, to the satisfaction of the arresting officer subject to the conditions as laid down under Section 438(2)of the Code of Criminal Procedure, 1973. The prayer for anticipatory bail of the petitioner No. 1 is rejected.

Accordingly, the application for anticipatory bail being CRM 8018 of 2020 is disposed of.
