The petitioners undertake to affirm and stamp the petition/application as per the Rules within one month of resumption of normal functioning of the Court. The petition is taken up through video conference on the basis of such undertaking.

The learned Counsel appearing on behalf of the State has fairly submitted that no charge-sheet has been filed against Ashok Mondal. It is further submitted that the name of the petitioner no.2 is not appearing from the FIR and the charge-sheet filed by the prosecution. In view of the aforesaid submission and having regard to the fact that the name of the petitioner no.2 is neither appearing in the FIR nor does it appear in the charge-sheet filed by the prosecution, this application is disposed of by recording that the petitioner no.1 has been discharged and no criminal proceeding has been initiated against the petitioner no.2. The application for anticipatory is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
