Crt.12 Rejected CRM 8051 of 2020 (Via Video Conference) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kaliachak PS Case No. 215 of 2018 dated 03.04.2018 under Sections 341/326/307/302/120B of the IPC and under Section 27 of the Arms Act( corresponding to GR Case No. 1261 of 2018).

Mr. Apurba Kumar Datta ...for the State Petitioner undertakes to affirm and stamp the petition/application as per Rules within 48 hours of resumption of normal functioning of the Court. Subject to such undertaking, the application is taken up for hearing through video conference. The petitioner has renewed the prayer for bail. The prayer for bail was earlier rejected on 7th August, 2018 and 17th August, 2020. The Coordinate Bench had relied upon materials disclosing prima facie involvement of the petitioner and in the commission of the alleged crime as one of the assailants who fired at the victim who suffered gunshot injury and ultimately died.

We do not find any reason to re-visit the issue as there has been no changing circumstances since the last order of rejection. CRM 8051 of 2020 stands thus rejected.

Learned advocate as well as the other concerned authorities shall act on the copy of the order downloaded from the official website of this Court.
