Mr. Sanjoy Bardhan Mr. Palash Ch. Majhi ...for the State Petitioner undertakes to affirm and stamp the petition/application as per Rules within 48 hours of resumption of normal functioning of the Court. Subject to such undertaking, the application is taken up for hearing through video conference. The learned counsel for the petitioner has renewed his prayer for bail as it was earlier turned down by a Co-ordinate Bench being CRM No. 7627 of 2019, on 3rd September, 2019.

Having considered the earlier order rejecting the bail and materials on record and bearing in mind the prima facie involvement of the petitioner in the alleged joint possession of 22 kg. contraband article, which is above the commercial quantity and having regard to the fact that charge sheet has been submitted and a supplementary charge sheet has already been filed as well as the trial has commenced, we are not inclined to release the petitioner on bail. Moreover there has been no change in circumstance since the last order of rejection.

However, we direct the trial court to expedite the trial and conclude the trial as expeditiously as possible preferably within a period of one year from the date of fixed next without granting any unnecessary adjournment to either of the parties. CRM 8060 of 2020 stands thus rejected.

Learned advocate as well as the other concerned authorities shall act on the copy of the order downloaded from the official website of this Court.
