However, withdrawal is sought for with liberty to sue afresh on the self-same cause of action.

Having heard learned counsel for the petitioner and Mr. Tarak Karan, learned counsel for the State, the writ application being, W.P.A. 8521 of 2020 is allowed to be withdrawn with a liberty to sue afresh on the self-same cause of action if such cause of action survives.
