Md. Anwar Hossain Ms. Sreyashee Biswas ...for the State The petitioner undertakes to affirm and stamp the petition/application as per the Rules within one month of resumption of normal functioning of the Court. The petition is taken up through video conference on the basis of such undertaking.

The learned counsel for the petitioner submits that some of the co-accused similarly placed as that of the petitioners have been granted regular bail by a coordinate bench on September 18, 2020 (CRM 6858 of 2020 in the matter of Somnath Paral & Ors.)

The learned advocate appearing for the State opposes the prayer for bail and draws attention of this Court to the statement of the victim recorded under Section 164 of the Code of Criminal Procedure. We have perused the statement of the victim recorded under Section 164 of the Cr.P.C. and on analyzing the same in the background of the present case as well that other co-accused persons similarly placed are on bail we allow this application for anticipatory bail.

Accordingly, we direct that in the event of arrest, the petitioner be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only), with two sureties of like amount each, to the satisfaction of the learned Additional Chief Judicial Magistrate, South 24-Parganas and also subject to the conditions as laid down under Section 438(2) of the code of Criminal Procedure, 1973 and on further condition that the petitioner shall meet the investigating officer once in a week until further orders.

Accordingly, the application for anticipatory bail of the petitioner is, thus, allowed.
