Mr. Nasim Ahmed, Advocate ...for the Petitioner Mr. S.S. Imam, Advocate Mr. Subroto Roy, Advocate ...for the State (BAIL - REJECTED) Petitioner undertakes to affirm and stamp the petition/ application as per Rules within one month from date. Subject to such undertaking, the application is taken up for hearing. Learned Advocate of the petitioner submits that the petitioner has been falsely implicated in connection with the instant case and is languishig in jail unnecessarily. It is submitted that the mother of the complainant has inflicted the said case on the false imputation just to satisfy her grudge against the petitioner.

The learned Advocate of the State opposes the prayer for bail. It is submitted that serious offences have been committed by the petitioner which would be reflected from the statement of the victim minor girl recorded under Section 164 of the Code of Criminal Procedure.

After considering the respective submissions advanced by the counsel and upon perusal of the statement of the victim girl who appears to be 16-17 years of age, we do not feel that it is a fit case where the petititoner should be enlarged on bail. Prayer for bail is thus rejected.
