Report of Sub-Inspector of Police associated with Islampur Police Station, Uttar Dinajpur dated 16.02.2022 submitted by Mr. Sur, learned APP, appearing for the State be kept on record. The said report is accompanied with a statement recorded by the Investigating Officer of one Akhilesh Kumar Verma who is the present Manager of Kumarika Tea Project as also with an affidavit affirmed by him.
The contentions in the statement as well as the affidavit reflect that Kumarika Tea Project under the Proprietorship of Jayshree Tea & Industries Ltd. do not intend to pursue the litigation which was initiated at the instance of the erstwhile
Manager being Islampur Police Station Case No. 285 of 2014 dated 22.02.2014.
In view of the nature of the offences complained of, I am of the opinion that further continuance of the proceedings is unwarranted as the parties have compromised the issues of dispute between them and the Company has got no allegation against the present petitioner or the other accused persons who have been implicated and named in the charge-sheet. Accordingly, all further proceedings arising out of Islampur Police Station Case No. 285 of 2014 dated 22.02.2014 as also the charge-sheet submitted therein in respect of the present petitioner as well as all the other accused persons who have been named in the charge-sheet are hereby quashed.
With the aforesaid observations, the revisional application being CRR 1485 of 2020 along with CRAN 1 of 2022 is hereby allowed.
Interim order, if any, is hereby made absolute. All other pending connected applications, if any, are consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
