This revisional application has been filed with a prayer for expeditious disposal of an interlocutory application filed under Section 151 of the Code of Civil Procedure in Title Suit No.309 of 2019, pending before the leaned Civil Judge (Junior Division) at Bidhannagar. It is submitted by the learned advocate appearing on behalf of the petitioner that the said application has not been taken up for hearing and adjournments have been granted. Learned advocate for the opposite parties/defendants opposes such contention of the petitioner and submits that there has not been any delay on the part of the Court in taking up the matter. The learned advocate for the opposite parties/defendants also submits that the opposite parties/defendants will file their written objection to the said application.

Time to file written objection to the application under Section 151 of the Code of Civil Procedure is extended by a

period of 10 days from date. The matter should be disposed of within a week from the next date fixed.

It is made clear that this Court has not gone into the merits of the case of the petitioner and the learned court below will proceed independently and in accordance with law.

This direction shall not be construed as any direction on the merits of the application.

The revisional application is disposed of.

There will be, however, no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
