Mr. Srijib Chakraborty Mr. Sunny Nandy ...for the petitioner A strong prima facie case is made out by the petitioner as regards respondent No.5 having been transferred to Mehendigram in a post equivalent to that which in the petitioner is at present serving, for which the petitioner has to travel about 70 kilometers per day, as opposed to the meagre distance of 12 kilometers between the present residence of the respondent No.5 and the latter's current place of service. Learned counsel for the petitioner argues that, despite the petitioner having applied for a transfer to Mehendigram in the said post long back, such application/representation was not considered by the respondent-authorities prior to transferring
the respondent No.5 to Mehendigram, thereby rendering the petitioner's application, which is otherwise more amenable to reason, infructuous. However, since none appears on behalf of any of the respondents despite service, let the matter be enlisted on November 5, 2020. In the meantime the petitioner shall serve a further notice on the respondents as regards the returnable date and satisfy the Court as to the service on the next date of hearing.
Liberty is given to the petitioner to mention the matter at the first sitting of Court on November 5, 2020 for being taken out of turn, if necessary, subject to notice on the respondent authorities.
