Mr. Bhattacharjee, learned advocate appearing for the petitioners strenuously argues that the petitioners have been falsely implicated. Their names do not feature in the First Information Report. Similarly situated persons have already been enlarged on bail. Upon completion of investigation charge sheet has also been filed and as such, further custodial interrogation of the petitioners is not necessary.
Mr. Banerjee, learned advocate appearing for the State opposes the petitioners' prayer and draws our attention to several documents in the case diary.
Records reveal that a coordinate bench of this Court rejected the application for anticipatory bail being CRM No.5252 of 2020 preferred by one Md. Abdul Toyab @ Md. Abdul Taiyab and prima facie it appears that the petitioners herein are similarly situated with Md. Abdul Toyab @ Md. Abdul Taiyab. The materials in the case diary disclose the involvement of the petitioners in the alleged offence. In view thereof, the petitioners' prayer for anticipatory bail is refused and the application being CRM No.8146 of 2020 is rejected.
