Jiten Bagdi And ANR v. State Of West Bengal
20.10.2020 SL No.61 Court No.12 (gc) CRM 8154 of 2020 (Via Video Conference) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Labpur P.S. Case No.176/2019 dated 18/08/2019 under Sections 448/323/325/427/354/379/506/34 of the Indian Penal Code. And In the matter of: Jiten Bagdi & Anr.
....Petitioners.
Mr. Sujoy Sarkar ...for the Petitioners.
Mr. Pradipta Ganguly ...for the State.
The petitioner undertakes to affirm and stamp the petition/application as per Rules within one month of resumption of normal functioning of the Court. Subject to such undertaking, the application is taken up for hearing through video conference. The learned Counsel for the petitioners submits that they have been falsely implicated in this case.
The learned Counsel for the State, however, opposes the prayer for anticipatory bail.
Having considered the materials on record, the disclosure of the name of the petitioner by the victim in the statement under Section 164 Cr.P.C. and the injury report, we are not inclined to release the petitioner on bail.
Accordingly, the application for anticipatory bail being CRM 8154 of 2020 is, thus, rejected.
All parties are to act on a website copy of this order on the usual undertaking.
