The petitioners allege that the Pradhan of the Dakshin Chandipur Gram Panchayat, Manikchak Development Block, Malda has indulged in irregularity and illegality at the time of floating the tender bearing NIT No.01/DCGP/2019, NIT No.02/DCGP/2019, NIT No.03/DCGP/2019 and NIT No. 04/DCGP/2019.

The petitioners approached the office of the Block Development Officer by filing representation on 13th July, 2020 followed by several reminders.

The petitioners allege that the representations filed by them have not been considered by the Block Development Officer till date.

The learned advocate appearing for the Pradhan of the Gram Panchayat submits, upon instruction, that the tender was floated in the year 2019 and by now the work of the tender has already been completed.

According to the Pradhan, the writ petition has presently become infructuous.

As it appears that the petitioners being the members of the said Gram Panchayat have pointed out several irregularities on the part of the Pradhan at the time of issuance of the tender notices, by filing a representation before the Block Development Officer in July, 2020 and the same has been kept pending for a considerable period of time, accordingly, the instant writ petition is disposed of by directing the respondent No.4 being the Block Development Officer, Manikchak Development Block, Malda to consider the representation filed by the petitioners, strictly in accordance with law, after giving an opportunity of hearing to all the necessary parties, within a period of twelve weeks from the date of communication of a copy of this order. The said respondent shall pass a reasoned order and communicate the same to all the necessary parties immediately thereafter.

In the event the Block Development Officer is of the opinion that there is indeed being irregularity and illegality at the time of processing the aforesaid tenders, then necessary steps shall be taken by the said respondent to deal with the same, in accordance with law.

W.P.A. 8627 of 2020 is disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
