The petitioner undertakes to affirm and stamp the petition as per the Rules within one week of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

The prayer was earlier rejected in the year 2017 and the petitioner suggests that there is no case made out against the petitioner since the allegation is that the petitioner siphoned away funds whereas the audit report reveals that the petitioner had accounted for the funds or had returned the same.

The ground that the petitioner urges is more appropriate at the trial. It is true that the previous prayer was rejected as far back as in 2017, but despite such rejection it is evident that the petitioner has been absconding.

In the light of such conduct, the present prayer cannot be acceded to.

CRM 8215 of 2020 is disposed of.
