(Via Video Conference) Mr. Tarunjyoti Tewari ... for the petitioner Mr. Raja Saha Mr. Rupsha Chakraborty ... for the State The petitioner has complained against one Iswar Chandra Roy, for cheating and breach of trust. After registering FIR, investigation was conducted and charge sheet has been filed being Kandi Police Station C/S No.394/2021 under Section 420/406/120B/34 of the IPC against one Iswar Chandra Roy and Goutam Ray. The petitioner submits that since after registration of the complaint, and filling of the before the Ld. Trial Court, charge sheet he is being threatened and is unable to enter into his residence or visit his village. It is also submitted, that his wife and children are being regularly harassed by certain persons acting at the instance of the said Iswar Chandra Roy.

Counsel for the State submits that there is no formal allegation of complaint lodged by the petitioner in this regard. However, since the petitioner expresses threat to his life and person, and that he is unable to

enter into his residence or visit his village out of fear, the Officer-in-Charge, Kandi Police Station, may depute an appropriate person to accompany the petitioner back to his residence, and ensure that there is no breach of peace in the area.

The Officer-in-Charge, Kandi Police Station shall also immediately attend to any complaint lodged by the petitioner as regards any threats received from any person.

With the aforesaid observations, the writ petition is disposed of.
