Mr. Saibal Bapuli Mr. Arijit Ganguly ...for the State The Trial Court issued warrant of arrest against the petitioners on 30th July, 2019 in connection with GR Case No. 446 of 2018 arising out of Nandigram Police Station Case No. 122 of 2018 under various penal provisions including sections 307 and 379 of the Indian Penal Code.

Be it mentioned here that charge-sheet was filed in connection with the above case on 30th June, 2019. Since the present petitioners being the accused persons absconded, warrant of arrest was issued against them. The instant revisional application was filed only to pray that the warrant of arrest issued against the petitioners may not be executed under the garb of quashing of entire criminal proceeding.

Having heard learned counsel for the petitioners and the learned Public-prosecutor-in-charge and on perusal of the entire materials on record this Court directs the petitioners to surrender before the learned Additional Chief Judicial Magistrate, Haldia, within a fortnight and in the meantime the warrant of arrest issued against

them shall not be executed by the police authority. If the petitioners failed to comply with the above direction the police authority is at liberty to execute the warrant of arrest.

The instant revisional application is thus disposed of on contest however, without costs.
