Court no. 34

IN THE HIGH COURT AT CALCUTTA

CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE CRR 1508 of 2020 In the matter of : Smt Protima Bag & Anr.

.......petitioners.

In Re : An application under Section 482 Cr.P.C. Mr. Manab Thakur Mr. Nilendra Narayan Ray ....for the petitioners.

Mr. Madhusudan Sur, APP Mr. Dipankar Pramanick ....for the State.

Learned advocate for the petitioners as well as the opposite party appears before this court.

It has been submitted that the disputes and differences have been settled between the parties. The offence complained of are under Section 341/323/427/506/34 IPC and Under Section 24 of M.W.P.S.C Act .

Mr. Sur, learned advocate appearing on behalf of the State has submitted memorandum of evidence, which reflects that the chargesheet has already been submitted. In view of the provisions of Section 24 of the M.W.P.S.C Act, I am of the opinion that it would be fit and

proper in this circumstances, to examine the C.S.W 1, Jagadish Chandra Bag by the learned trial court on the next date so fixed(after framing of charge).

Learned trial court after the evidence of C.S.W1 is over would consider if the further progress of the trial is required or not. If the same is not required, the learned trial court would be at liberty to drop the proceedings and take the consequent decisions.

With the aforesaid observations, CRR 1508 of 2020 is disposed of.

All pending applications, if any, are consequently disposed of.

Inter order, if any, is hereby vacated.

Memorandum of evidence submitted by the learned advocate for the State be kept with the record. All parties are to act on the server copy of this order duly downloaded from the official website of this court. (Tirthankar Ghosh, J. )
