IN THE HIGH COURT AT CALCUTTA

Criminal Miscellaneous Jurisdiction C.R.M. No. 8278 of 2020 Chintu Sk @ Khokka @ Chentu Sekh -vsThe State of West Bengal In Re: An application for bail under Section 439 CrPC in connection with Samserganj P.S. Case No.212 of 2019 dated 20.8.2019 under sections 489B/489C of the Indian Penal Code.

Mr. A. Das ...for the petitioner.

Mr. Swapan Banerjee, Mrs. Purnima Ghosh ... for the State.

The advocate-on-record for the petitioner undertakes to affirm and properly stamp the petition as per the rules within one month of resumption of normal functioning of the court. The petition is taken up through video-conference on the basis of such undertaking.

The learned Advocate appearing for the petitioner submits that the petitioner is an innocent person and he is no way connected with the present case. He has been falsely implicated in the present case. Therefore, the petitioner should be granted bail. Mrs. Ghosh, learned Advocate appearing for the State opposes the prayer for bail and produces the case diary. Considering the submission as advanced by the learned Advocate appearing for the parties and after going through the case diary, we find that Rs.50,000/- fake currency was recovered exclusively from the possession of the petitioner. Considering the same, in our opinion, the petitioner should not be granted bail. Accordingly, the prayer for bail of the petitioner is rejected at this stage.

However, we direct the learned trial court to expedite the trial and complete the same within eight months.

CRM No.8278 of 2020 is disposed of.
