It appears that upon completion of investigation charge sheet has been filed and thereafter, upon obtaining the chemical report, supplementary charge sheet has also filed. The charges have also been framed on 16th March, 2021.
Since contraband substance above commercial quantity was recovered from the possession of the petitioner, the provisions of Section 37 of the N.D.P.S. Act are attracted and in view thereof, we are not inclined to exercise any discretion in favour of the petitioner at this stage.
However, the learned Court below is directed to conclude the trial, as expeditiously as possible, without granting any unnecessary adjournment to either of the parties.
The application being CRM 8282 of 2020 is, accordingly, dismissed.
