Ms. Faria Hossain Ms. Sonali Das ... For the State. Apprehending arrest in connection with Nandigram Police Station Case No. 272 of 2020 dated 24-08-2020 under Section 376(2)(i)(n)/506 of the Indian Penal Code and under Section 6 of the Protection of Children from Sexual Offences(POCSO) Act, the present application has been filed. Mr. Chatterjee, learned advocate appearing for the petitioner submits that the petitioner was in a relationship with the victim and the present case has been falsely instituted. To that, learned advocate for the petitioner draws the attention of this court to an order of anticipatory bail passed by the learned Sessions Court.

Learned advocate for the State draws the attention of this Court to the statement of the victim recorded under Section 164 of the Code of Criminal Procedure as well as the medical evidence so collected by the Investigating Agency.

We have perused the medical evidence and the supporting materials collected by the Investigating Agency and on assessment of the same, we are of the opinion that the petitioner is not entitled to the privilege of anticipatory bail and the prayer of the petitioner is rejected. With the above observations, the application being CRM 8291 of 2020 is, thus, disposed of.
