The petitioners undertake to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking.

The petitioners claim that they had nothing to do with the alleged dacoity and false charges have been levelled.

The State says that all three persons belong to a local gang operating in the Kandi region and these petitioners were aware that an employee of Bandhan Bank would be returning after collecting monies from small depositors. The entire money was stolen from the concerned bank employee. The State says that a

substantial part of a money was recovered from the residence of the first petitioner. Monies were also recovered from the other two petitioners. The second and third petitioner were also identified by the survivor at the T.I. parade.

Considering the above, the petitioners' prayer for bail is rejected.

CRM 8313 of 2020 is dismissed.
