For the State The petitioner is aggrieved by the fact that notwithstanding a written complaint dated 6th October, 2020, Marishada Police Station has not registered FIR. Counsel for the State submits that the said complaint was received on 10th October, 2020 and an FIR No. 206 of the Marishada Police Station is registered inter alia under Sections 447/341/323/379/427/506/34 IPC. It is submitted that investigation is on. It is also appears from the records that a complaint has been registered against the petitioner at the instance of the private respondents and investigation is also on. In respect of the incident of the ransacking of the petitioner's bar and restaurant, another FIR has also been registered by the Marishada Police

Station against complaint of the petitioner's father and investigation is on.

In that view of the matter, the Court see no inaction on the part of the police. Be that as it may since the writ petitioner apprehends threat to a life and property by the private respondent, the Officer-in-Charge, Marishada Police Station directed to ensure that there is no breach and peace in the locale and shall continue to maintain vigil over the said property.

In the event, the writ petitioner requests for police protection, the Marishada Police Station may afford the same to the petitioner upon payment of necessary costs.

The instruction for the counsel for the State received from the Marishada Police Station is taken on record.

With the aforesaid observation, WPA 8826 of 2020 is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
