Mr. Kushal Chatterjee Mr. Debabrata Roy ..for the petitioner This revisional application has been filed by the defendant in Misc. Appeal No. 56 of 2018 arising out of Title Suit No. 458 of 2016 pending before the learned Additional District Judge, Fast Track Court, Barasat, District North 24 Parganas.

The learned Advocate for the petitioner submits that the Misc. Appeal is at the stage of hearing and the several dates have been fixed for hearing of the same but the matter was not taken up for some reason or the other. The prayer is innocuous as the petitioner prays for expeditious disposal of the Misc. Appeal. Having gone through the records, this Court finds that the Misc. Appeal is at the stage of hearing. This Court has not gone into the merits of the Misc. Appeal. The learned Court below is directed to dispose of the Misc. Appeal as expeditiously as possible, preferably within a period of two months from the next date fixed. The

learned Court below will proceed independently and in accordance with law without being influenced by any observations made hereinabove.

The petitioner is directed to serve copies of the revisional application along with a server copy of this order upon the opposite parties as also the learned Advocate in the learned Court below within a week from date. This revisional application is disposed of.

There will be however no order as to costs.

Urgent photostat certified copy of this order be given to the parties on priority basis, if the same is applied for.
