In this Habeas Corpus petition, this Court must notice a difference from the usual Habeas Corpus applications since all the parties are freely represented and the purported detenue does not complain of any unlawful detention.
The petitioner claims to be an acquaintance of the purported detenue which developed into a friendship. The purported detenue is also the wife of the Respondent No.4. Although several allegations have been raised in this Habeas Corpus application connected to the illegal detention of the purported detenue, one Anindita Das, the
purported detenue appears through Learned Advocate, Ms. Amrita Panja Moulick, today and refutes such allegations. It is submitted by Ms. Moulick that her client is not under any illegal or unwarranted detention and she is presently living free on her own volition.
The State is represented by Mr. Mukherjee, Learned Additional Public Prosecutor (APP) with Mr. Ahmed, Learned Counsel.
The attention of this Court is drawn to the previous order of this Hon'ble Court dated 9th March, 2021 by which the parties were referred to mediation for resolving their outstanding disputes.
However, since the parties and, particularly the purported detenue appearing through her Learned Counsel, Ms. Moulick, submit that the reliefs claimed by way of Habeas Corpus have been now rendered infructuous, WPA 8832 of 2020 stands accordingly disposed of as infructuous.
In view of the disposal of WPA 8832 of 2020 (supra), this Court is not required to make any observation on the pendency of any mediation or, otherwise, inter se the parties.
All concerned parties shall act in terms of the copy of the order downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties on compliance of necessary formalities.
