Mr. Soumyajit Mishra Mr. B.Sen ...........for the petitioners Mr. Anuran Samanta ........for the ECI The stand of the learned counsel appearing for the Chief Election Commission and the other respondents is that a sum of Rs. 4,12,033/- have already been received by the petitioners for the unpaid amount for goods supplied to the Chief Election Commissioner.

Learned counsel appearing for the petitioners submits that the balance dues, which are to be paid, may be considered by the respondents in terms of a representation made by the petitioners on 12.08.2020.

After hearing learned counsel, this Court is of the view that since the present writ petition is for payment of the outstanding amount of Rs. 43,500/-, WPA 8842 of 2020 may be disposed of with a direction on the respondent no. 3, being the

District Election Officer, Kolkata (North), to consider the representation of the petitioners dated 12th August, 2020 and dispose of the same within a period of three weeks from date. If it is found that the petitioners are entitled to the balance amount, as prayed for in the writ petition, the respondent no. 2 shall disburse the same to the petitioners within a period of two weeks from the date on which such representation is disposed of.

Admissible rate of interest @ 6% shall be paid to the petitioners along with the amount which is due to be disbursed by reason of the delay in disbursing the total amount of the petitioners.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
