Mr. Chatterjee, learned advocate appearing for the petitioner prays for anticipatory bail in connection with the instant case.

Mr. Sur, learned advocate appearing for the State submits that the petitioner's name is not appearing either in the FIR or in the statement of any of the witnesses under Section 161 of the Code of Criminal Procedure or in the charge-sheet. As such, according to him, there is no scope of apprehension of arrest of the petitioner so far as the present case is concerned.

In view of the aforesaid submission advanced by the learned advocate appearing for the State, we are of the

opinion that the application for anticipatory bail is not maintainable so far as the present petitioner, namely, Anuwarul Biswas is concerned.

With the aforesaid observations, the application for anticipatory bail, being CRM 8438 of 2020, is disposed of. (Tirthankar Ghosh, J.) (Tapabrata Chakraborty, J.)
