Heard both the parties.

In this matter petitioners have challenged the impugned order dated 3rd March, 2020 passed by Senior Joint Commissioner, State Tax, Asansol Circle, being respondent No.2 and it is the allegation of the petitioners that while passing the impugned order respondent No.2 has not considered his written submission which has been annexed to the writ petition as it appears at Page 66 of the writ petition. Learned advocate for the State respondents denies about filing of such written submission. However, in the interest of justice, this writ petition is disposed of by setting aside the aforesaid impugned order dated 3rd March, 2020 by directing the respondent No.2 for limited purpose of considering the aforesaid written submission, which has been annexed to this writ petition as it appears at Page 66 of the writ petition

and after taking into consideration the aforesaid written submission, the respondent No.2 will pass a reasoned and speaking order on the issue confining to the written submission after giving an opportunity of hearing to the petitioners within eight weeks from the date of communication of this order. Petitioners will file fresh copy of the aforesaid written submission as appears at Page 66 of the writ petition before the respondent No.2 within a week from date.

It is recorded that this Court has not gone into the merits of the aforesaid written submission and the argument and the respondent No.2 while considering the aforesaid written submission will act strictly in accordance with law.

WPA 8916 of 2020 is disposed of.
