Bail was rejected on 18.10.2020 without considering the medical report. Upon perusal of the medical report, on 26.8.2020 bail has been granted to opposite party no.1. In view of the aforesaid circumstances, it cannot be said that the earlier order of rejection of bail was not taken into consideration. Learned Judge had also considered other relevant materials including the statement of the victim recorded under Section 164 of the Code of Criminal Procedure. Hence, we do not wish to interfere with the order granting bail to opposite party no.1.

Accordingly, the application for cancellation of bail is dismissed.
