21.10.2020 SL No. 186 ss CRM 8485 of 2020 (Through Video Conference) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Domkal P.S. Case No.229 of dated 10.05.2020 under sections 147/148/149/307/120B of the Indian Penal Code and section 25(I) of the Arms Act and sections 3/4 of the Explosive Substances Act. And In the matter of: Asanur Islam @ Rentu Biswas & Ors. Mr. Anisur Rahman ... ... for the Petitioners Mr. Imran Ali Mr. M.F.A. Begg ... ... for the State Petitioner no. 1 has been arrested. Accordingly, the application for pre-arrest bail of petitioner no. 1 is dismissed as infructuous. Keeping in mind the extent of complicity of the petitioner nos. 2 and 3 in the alleged crime and as no medical report endorsing injuries due to bomb or firearms is produced before us, we are of the opinion custodial interrogation of the petitioner nos. 2 and 3 is not necessary and they may be granted anticipatory bail.

Accordingly, we direct that in the event of arrest, the petitioner nos. 2 and 3 shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.

This application for anticipatory bail is, thus, partly allowed.
