Mr. Saryati Datta ... ... for the Petitioners Mr. Ranabir Ray Chowdhury Mr. Shiladitya Banerjee ... ... for the State It is submitted on behalf of the petitioners that they were exonerated in the departmental proceeding on the self-same accusation.

Learned lawyer for the State submits that petitioners did not cooperate with investigation. We have considered the materials on record and bearing in mind the nature of allegations in the light of the aforesaid submission made on behalf of the petitioners, we are of the opinion though custodial interrogation is not necessary, petitioners require to co-operate with investigation in accordance with law.

Accordingly, we direct that in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that petitioners shall meet the investigating officer once in a week until further orders.

This application for anticipatory bail is, thus, allowed. The parties shall act in terms of the copy of the order downloaded from the official website of this court. (Abhijit Gangopadhyay, J.) (Joymalya Bagchi, J.)
