The petitioner undertakes to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking. The petitioner is the father-in-law of the victim who apparently committed suicide. According to the petitioner, though the husband of the victim was initially arrested, he has now obtained bail.
The State says that the charge-sheet has been submitted but this petitioner had been absconding for some time. The State also says that there is sufficient material to proceed against the petitioner on account of the perceived dowry death.
Since the investigation has been completed, no useful purpose will be served in taking the petitioner into custody at
this stage. However, the petitioner must attend every date fixed for trial if charges are pressed against him and any unexplained absence will entitle the trial court to cancel the bail without reference to this court.
In the event of arrest, the petitioner will be enlarged on bail upon furnishing a security of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer. The petitioner will also abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
CRM 8498 of 2020 stands disposed of.
